Terms of Service
Last updated: August 2026 · Version 1.0 · Effective date: 26 August 2026
1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of kery.io, operated by Adam Kery trading as kery.io (ABN: 76 776 757 103) ("kery.io", "we", "us", or "our"), including our website at https://kery.io, dashboard, APIs, and the Kery Chrome browser extension (collectively, the Service).
By creating an account, accessing the dashboard, installing the extension, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Definitions
In these Terms:
- Account means the account you create to access the Service.
- Community Log means the community feature that lets users submit and view entries such as Ghost Job Alerts and Interview Lessons.
- Contribution means content you submit for publication on the Service, including a Community Log entry.
- Privacy Policy means our privacy policy at https://kery.io/privacy, as updated from time to time.
- Service means our website, dashboard, APIs and the Kery Chrome browser extension, together with all related features.
- Terms means these Terms of Service.
- we, us or our means the operator of kery.io identified above, and you means the user of the Service.
3. Eligibility
You may use the Service only if you have the legal capacity to enter a binding agreement and are at least 18 years of age. By accessing the Service, you confirm that the information you provide is accurate and that you meet these requirements.
4. User Accounts
If you register for an account, you are responsible for safeguarding your login details, extension token, and any other credentials associated with your profile. You are responsible for activity that occurs through your account, except to the extent that the activity results from unauthorised access occurring despite you taking reasonable steps to keep your credentials secure and promptly notifying us, or results from our own act or omission.
You must tell us immediately at support@kery.io if you become aware of unauthorised access, suspected compromise of your extension token, or any other security incident affecting your account. We are not responsible for loss or damage arising from your failure to maintain reasonable account security or to notify us promptly.
When choosing a display name or account identifier, you must not:
- Adopt the name of another individual or organisation without proper authority
- Use a name that infringes another party's trade mark, copyright, or other proprietary rights
- Select a username that is misleading, offensive, vulgar, or otherwise inappropriate
We may refuse registration, suspend access, remove content, or close accounts at our reasonable discretion where we believe these Terms have been breached, where conduct poses a risk to other users or the Service, or where we are required to act by law.
5. Use of the Service
kery.io provides tools to help job seekers organise applications, save job listings, assess listing signals (including ghost-job risk indicators), review market-worth estimates, and prepare for interviews using automated and AI-assisted analysis.
You may use the Service only for lawful personal or internal business job-search purposes, subject to these Terms and our Privacy Policy. We may modify, suspend, or discontinue any part of the Service where reasonably necessary for maintenance, security, compliance, or product improvement.
A free account includes Fit Check and the ATS Readability Check, subject to the weekly limits for your plan. These tools process the resume or job information you provide to generate an on-screen result, are provided for general information only, and are subject to these Terms (including the disclaimers and the Australian Consumer Law section below). You must only submit your own resume or information, or information you are entitled to provide, and you must not submit another person's personal information without their consent.
6. Chrome extension
The extension operates only on supported job listing pages (such as LinkedIn and Indeed) when you interact with it. You must comply with the terms of use of any third-party site you visit while using the extension. kery.io is not affiliated with, endorsed by, or sponsored by LinkedIn, Indeed, or other job platforms referenced on our site.
7. AI and automated analysis
Features such as ghost-job risk scoring, repost detection, market-worth estimates, interviewer persona insights, and syndication research use automated systems and third-party services. Outputs may be incomplete, outdated, or incorrect. You agree to use these features as informational aids only and to verify important details independently before making decisions.
8. Acceptable Use
By using the Service, you represent and warrant that:
- You have the legal capacity to agree to these Terms and will comply with them in full
- You are at least 18 years of age
- You will not access the Service through bots, scrapers, scripts, or other automated or non-human means except through functionality we expressly provide
- You will not use the Service for any unlawful, fraudulent, or unauthorised purpose
- Your use of the Service will comply with all applicable laws and regulations, including Australian federal, State, and Territory law where it applies to you
You must not use the Service to:
- Upload, post, or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or otherwise objectionable
- Impersonate any person or entity, or misrepresent your identity, qualifications, or affiliation with any person or entity
- Infringe our intellectual property or the intellectual property, privacy, or other rights of any third party
- Introduce viruses, malware, trojan horses, or other code intended to disrupt, damage, or interfere with the proper operation of the Service or connected systems
- Interfere with, disrupt, overload, or place an unreasonable burden on the Service, our infrastructure, or networks connected to the Service
- Attempt to bypass, disable, or circumvent security measures, authentication controls, rate limits, or access restrictions
- Harvest, scrape, or collect email addresses, contact details, or other personal information of users from the Service without consent and lawful authority
- Use the Service in any manner that breaches applicable laws, industry codes, or third-party platform terms
Important: You may not use kery.io for any purpose that promotes dishonesty, misrepresentation, or unethical conduct in recruitment or employment. Our tools are intended to help you track applications, understand listing signals, and present your genuine qualifications clearly. They must not be used to fabricate experience, invent credentials, falsify application materials, or deceive employers, recruiters, or interviewers.
9. No Guarantee of Employment
kery.io does not guarantee that you will receive interviews, job offers, responses from employers, or favourable outcomes from any application. Risk scores, persona insights, and market-worth signals are analytical tools, not predictions of hiring decisions.
Employers control their own hiring processes. A low ghost-job risk score does not mean a role is legitimate in every respect, and a high risk score does not mean a role is fraudulent. We do not warrant the accuracy, completeness, or timeliness of any listing, employer behaviour, or third-party data source.
10. User Responsibility
You are solely responsible for:
- The job applications you submit and communications you have with employers
- Ensuring that pasted interviewer context and other data you provide are used lawfully and appropriately, and that you are entitled to submit any interviewer role or seniority details, or public content you provide
- Decisions you make based on dashboard data, extension saves, or AI-generated outputs
- Keeping your extension token secure and regenerating it if it may have been exposed
- Compliance with third-party platform rules when browsing job sites
Community-submitted signals and user-contributed content, where available, reflect individual opinions and experiences. We do not verify every community entry and are not responsible for user-generated content posted by others.
11. User Contributions
Where the Service allows you to submit content for publication, including an entry to the Community Log such as a Ghost Job Alert or an Interview Lesson (a Contribution), the following applies in addition to the User Responsibility section above and our Privacy Policy.
You retain ownership of your Contributions. By submitting a Contribution, you grant kery.io a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, publish, and publicly display that Contribution on the Service, solely for the purpose of operating the Community Log feature and the Service more generally. To the extent permitted by law, you consent to us and our users using your Contribution in the ways described above without identifying you as the author and as edited for moderation, and you agree not to assert your moral rights under the Copyright Act 1968 (Cth) in respect of those acts.
This licence continues for as long as your Contribution remains published in accordance with our Privacy Policy, and ends when the Contribution is removed, whether at your request, on account deletion, or by us in accordance with these Terms, other than in respect of any anonymised or aggregated signal derived from your Contribution, which we may retain as described in our Privacy Policy.
You warrant that your Contribution does not contain personal information about any identifiable individual, is not defamatory, and does not infringe the intellectual property, privacy, or other rights of any third party. We reserve the right to review, edit, decline to publish, or remove any Contribution at our reasonable discretion, including where we consider it breaches this section, our Privacy Policy, or any applicable law.
Complaints and takedown. If you believe a Contribution or Community Log entry (including a Ghost Job Alert or Interview Lesson) is defamatory, infringes your rights, discloses confidential information, or otherwise breaches these Terms, you may report it to us at support@kery.io with enough detail to identify the entry and your concern. We will review each complaint we receive and, where we consider it appropriate, remove or disable access to the content. We aim to action complaints within 14 days of receiving them. We may also keep records of complaints and the relevant content for our legal and compliance purposes.
12. Intellectual Property
The Service, including its software, design, branding, and documentation, is owned by kery.io or its licensors and is protected under the Copyright Act 1968 (Cth), the Trade Marks Act 1995 (Cth), and other applicable Australian and international intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand assets without prior written permission. All other product names, logos and brands referred to on the Service, including those of third-party job platforms, are the property of their respective owners, and our reference to them does not imply any affiliation with or endorsement by them.
You retain ownership of the job application data and content you submit. You grant us a limited licence to host, process, and display that content solely to operate and improve the Service for you, as described in our Privacy Policy, and, in respect of Contributions, as described in the User Contributions section above.
13. Payments
kery.io offers a free Freemium plan with weekly usage limits, and a paid Active Job Seeker Pass subscription with higher weekly limits. The subscription price is shown in Australian dollars exclusive of tax. Applicable tax (including Australian GST) is calculated at checkout based on your billing location and is added to the total where required. We may introduce additional paid plans, credit packs, or premium features in the future. If you purchase paid access:
- Pricing, billing intervals, credit quantities, included features, and any applicable tax will be displayed clearly before you complete payment
- You authorise us or our payment processor to charge your nominated payment method, including on a recurring basis where you select a subscription
- GST or other applicable taxes will be calculated at checkout using Stripe Tax where you have a relevant tax registration. The checkout total is the amount payable
- Failure to pay an amount when due may result in suspension, downgrade, or loss of access to paid features until the account is brought current
- Credits do not expire. Any prepaid credits or analysis credits purchased through the Service remain in your account until you use them, unless your account is closed in accordance with these Terms or we are required to remove them by law
Any paid offering is also subject to the specific pricing terms shown at the time of purchase, which form part of your agreement with us.
14. Subscriptions, Auto-Renewal and Cancellation
Where you purchase a subscription, the following applies in addition to the Payments section above:
- Before you subscribe, we will clearly display the subscription price, the billing frequency (for example, monthly or yearly), the date your first payment will be taken, and that the subscription renews automatically.
- Your subscription will automatically renew at the end of each billing period, for a further period of the same length and at the then-current price, unless you cancel before the renewal date. Where required, we will remind you by email before a renewal, and we will always notify you before any change to your subscription price takes effect.
- You may cancel your subscription at any time through your account settings, or by contacting us at support@kery.io. Cancelling your subscription is designed to be as straightforward as signing up.
- If you cancel, your subscription will not renew for the next billing period. You will keep access to paid features until the end of the billing period you have already paid for, and you will not be charged again unless you choose to resubscribe.
- Any change to your subscription price will only take effect from your next billing period after we have given you reasonable notice, and you may cancel before the change takes effect if you do not accept it.
15. Refunds
If you purchase a paid plan, subscription, or credit pack:
- Refund eligibility, if any, will be stated at checkout or on the relevant product page before you pay
- Except where a non-excludable right applies, fees are generally non-refundable once a billing period has begun or digital content or credits have been made available to your account
- If you believe you were charged incorrectly, contact support@kery.io within 14 days with your account email and transaction details so we can review the matter
Australian Consumer Law: If you acquire the Service as a consumer within the meaning of the Australian Consumer Law, you have statutory rights and remedies that cannot be excluded, including consumer guarantees under the Competition and Consumer Act 2010 (Cth). Nothing in these Terms limits those rights. Where a major failure occurs with a paid service, you may be entitled to a remedy such as cancellation and a refund in accordance with law.
16. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided on an as is and as available basis. We disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except where such exclusion is not permitted by law.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that data will always be accurate or preserved without loss.
Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other non-excludable statutory right that applies to you.
17. Limitation of Liability
To the maximum extent permitted by applicable law, kery.io and its officers, directors, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Service.
Subject to any non-excludable rights, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) AUD $100.
Where the Australian Consumer Law or another applicable law implies a condition, warranty, or guarantee that cannot lawfully be excluded, our liability for breach of that condition, warranty, or guarantee is limited, at our option and to the extent permitted by law, to resupplying the relevant service or paying the cost of having the service supplied again. This limitation does not apply to services of a kind ordinarily acquired for personal, domestic or household use or consumption, where section 64A of the Australian Consumer Law does not permit liability to be limited in this way.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where such limitation is not permitted.
18. Indemnification
You agree to indemnify and hold harmless kery.io from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, your violation of third-party rights, or content and data you submit through the Service, including any Contribution. You are not required to indemnify us to the extent a claim arises from our own negligence, breach of these Terms, or wilful misconduct, and this clause does not limit any right or remedy you have under the Australian Consumer Law.
19. Termination
You may stop using the Service at any time. You may delete applications from your dashboard and request account deletion by contacting us.
We may suspend or terminate your access if you breach these Terms, if required by law, or if continued access creates risk to the Service or other users. Except where your breach is serious or we are required to act immediately by law or to protect the Service or other users, we will give you reasonable notice and an opportunity to remedy the breach before we suspend or terminate your access. If we suspend or terminate a paid account other than for your serious or repeated breach, we will refund any unused prepaid credits and the unused portion of any prepaid subscription. Upon termination, your right to use the Service ends, but sections that by their nature should survive (including limitations of liability, disclaimers, User Contributions, and indemnification) will remain in effect.
20. Suspension or Discontinuation of the Service
We may, at our discretion and where reasonably necessary, suspend, modify, or discontinue the Service (in whole or in part) at any time, including where required for maintenance, security, legal or regulatory compliance, or because we cease to operate the Service. Where reasonably practicable, we will provide reasonable notice of any material discontinuation via the website or by email.
If we permanently discontinue the Service, we will refund any unused prepaid credits or analysis credits remaining in your account at the time of discontinuation, calculated on a pro-rata basis reflecting the value of unused credits. Refunds will be processed to your original payment method within a reasonable period following discontinuation. Nothing in this clause affects any non-excludable right or remedy you have under the Australian Consumer Law.
21. Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms to the extent it is caused by an event beyond our reasonable control, including a failure of third-party infrastructure, telecommunications or hosting services, power outage, natural disaster, or government action. This clause does not limit your rights under the Australian Consumer Law and does not apply to your obligation to pay for services already provided. If a force majeure event continues for more than 30 days, either you or we may terminate the affected subscription, and we will refund any unused prepaid amount.
22. Governing Law and Disputes
These Terms are governed by the laws of Australia. You agree that the courts of Australia have non-exclusive jurisdiction to resolve disputes arising out of or in connection with these Terms or the Service, except where applicable law gives you the right to bring proceedings in another forum.
23. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your contract with us and obtain a refund of the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.
24. Privacy
Our handling of personal information is described in our Privacy Policy and is subject to the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to us.
25. Dispute resolution
Before commencing formal legal proceedings, you agree to contact us at support@kery.io and give us a reasonable opportunity to investigate and attempt to resolve the dispute in good faith. Nothing in this section prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.
26. General provisions
- Entire agreement: These Terms, together with our Privacy Policy and any purchase terms shown at checkout, constitute the entire agreement between you and kery.io regarding the Service, except for any non-excludable rights under law.
- Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law. Where a provision can be read down so as to be valid and enforceable, it will be read down rather than severed.
- No waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations where reasonably necessary for a restructure, sale, or continuation of the Service.
- Interpretation: Headings are for convenience only and do not affect interpretation. Words importing the singular include the plural and vice versa where the context requires.
- Notices: We may give you notice by email to the address linked to your Account or by posting on the Service. You may give us notice by email to support@kery.io. A notice sent by email is taken to be received when sent, unless we receive an automated delivery-failure message.
27. Changes to Terms
We may update these Terms from time to time. When we do, we will revise the Last updated date at the top of this page. Material changes may also be communicated through the website or by email where appropriate. If we make a material change that adversely affects a paid plan or subscription, we will give you at least 30 days' notice by email before the change takes effect. You may cancel the affected plan before the change takes effect and, if you do, we will refund any unused prepaid amount for that plan.
Your continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
